CARDS ON THE TABLE

Terms and Conditions

These terms and conditions apply to the Cards On The Table Zodiac App app for mobile devices, together with any related services operated by Casey Staton (collectively, the "Application"). Casey Staton is hereby referred to as the "Service Provider".

By downloading or using the Application, you agree to these Terms and Conditions. You should read them carefully before using the Application.

Software Licence & Scope of Service

Software Licence & Scope of Service These Terms of Service govern your use of the gameplay, matchmaking, online accounts, and related server-side services operated by the Service Provider. This Application is licensed, not sold, to you. Your download and installation of the software application container are governed exclusively by Apple’s Standard Licensed Application End User License Agreement (EULA), available at apple.com. Subject to your strict compliance with these Terms, the Service Provider grants you a personal, revocable, non-exclusive, non-transferable right to access and use the online features, cloud data infrastructure, and digital content within the Application. To the extent that any terms regarding software restrictions (such as reverse engineering, decompilation, or redistribution) overlap, the stricter restriction shall apply. Apple retains primary enforcement authority over the App Store software container, while the Service Provider retains all enforcement rights over the cloud services and proprietary game content.

Subject to your strict compliance with these Terms, the Service Provider grants you a personal, revocable, non-exclusive, non-transferable right to access and use the online features, cloud data infrastructure, and digital content within the Application.

To the extent that any terms regarding software restrictions (such as reverse engineering, decompilation, or redistribution) overlap, the stricter restriction shall apply, and Apple retains primary enforcement authority over the App Store software container, while the Service Provider retains all enforcement rights over the cloud services and proprietary game content.

Intellectual Property

The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos, and branding (the "IP"). Nothing in these Terms grants you any license or right to use the Service Provider's trademarks, logos, or branding for any purpose. You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed in or on the Application.

Account Suspension and Termination

The Service Provider may suspend or terminate your access to the Application or its services if you materially breach these Terms. Standard Breach Notice: For standard curable breaches of these service terms, the Service Provider will provide you with written notice via your registered email account. You will have fourteen (14) days from receipt of such notice to remedy the breach. If you fail to cure the breach within that window, your access will be terminated. Immediate Service Severance Exception: Notwithstanding the standard notice period, your access to premium features, database matching, subscriptions, or the application interface may be suspended or terminated immediately and without prior notice if: * Infrastructure Failure or Provider Discretion: A third-party infrastructure provider (including, but not limited to, Apple App Store systems or RevenueCat processing logic) flags an active transaction as fraudulent, revokes a store purchase token, registers a chargeback, or unilaterally severs data links to protect server security. * Severe Misconduct: You violate applicable local or federal laws, infringe on any intellectual property rights, or engage in malicious activity that threatens the immediate safety of the online community or the operational stability of the Application. Upon termination of access by either party, your right to use the online features of the Application ends immediately, and any ongoing background billing triggers will be treated in accordance with Apple's standard store deactivation timelines.

Infrastructure Failure or Provider Discretion:

A third-party infrastructure provider (including, but not limited to, Apple App Store systems or RevenueCat processing logic) flags an active transaction as fraudulent, revokes a store purchase token, registers a chargeback, or unilaterally severs data links to protect server security.

Severe Misconduct:

You violate applicable local or federal laws, infringe on any intellectual property rights, or engage in malicious activity that threatens the immediate safety of the online community or the operational stability of the Application.

Upon termination of access by either party, your right to use the online features of the Application ends immediately, and any ongoing background billing triggers will be treated in accordance with Apple's standard store deactivation timelines.

Age Eligibility & Use

The Application is strictly restricted to users aged 21 and older due to adult themes and content. Individuals under 21years of age are strictly prohibited from using the Application under any circumstances.

By accessing and using this Application, you represent that you meet these age requirements and are legally permitted to use it in your jurisdiction.

User Content

You retain ownership of your original answers and other content. You grant only the permission necessary to store, process and display that content to authorized participants, provide requested features and address support, security and safety concerns under the Privacy Policy. This permission does not authorize selling your answers, publishing them for advertising or using them to train an AI model.

Safety Reports and Operational Claims

Do not submit illegal content, threats, harassment, discriminatory abuse, scams, material exploiting children, non-consensual intimate content or content violating another person’s rights.

Online participants can report a table, block a partner or close a table using the available controls. Safety concerns can also be sent to cardsonthetabledatinggame@gmail.com. Blocking restricts the connection and removes contact sharing but does not itself delete all answer history. The App is not an emergency service.

Applicable legal obligations remain in force regardless of these Terms.

Service Modifications and Device Security

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your mobile device and access to the Application.

The Service Provider strongly advises against jailbreaking or rooting your mobile device, which involves removing software restrictions and limitations imposed by the official operating system of your mobile device. Such actions could expose your mobile device to malware, viruses, malicious programs, compromise your mobile device's security features, and may result in the Application not functioning correctly or at all.

Online Information

Local practice is stored on the iPhone and is not uploaded or synchronized by the App. Online play uses Superapp Cloud, powered by Supabase, to store account-linked profiles, invitations, private tables, answers, reviews, progress, results and consent choices. Online information is not merely temporary transit data or anonymized statistics.

Private tables are not end-to-end encrypted. Authorized operational/support personnel and infrastructure providers may process stored information to operate, secure or support the service, as described in the Privacy Policy.

AI Consent and Withdrawal

Optional AI reflections require separate, default-off consent from both players. Only aggregate category counts enter the on-device AI prompt; individual answers, questions, names, account identifiers and contact details are excluded.

Generated reflections are temporary screen content, not saved game history. Closing the screen or clearing consent removes the reflection from that screen. Withdrawal by an online participant takes effect on the other participant’s device when their App next successfully refreshes the consent state. Previously copied text cannot be recalled. AI does not change the game score or guarantee relationship compatibility.

Purchases, Platinum Membership, Billing and Cancellation

1. One-time Full Game purchase

Where available, the Full Game purchase is a one-time, non-consumable in-app purchase. It unlocks all 70 questions across seven categories, including the remaining questions beyond the seven-question free gameplay sample, full-game results and premium deck editing. Purchasing the unlock allows an existing game to continue without resetting its saved answers, progress or Wild Card status.

The Full Game purchase does not renew automatically and does not include Platinum membership benefits. It does not require a recurring subscription to retain the full-game entitlement, subject to purchase verification and any refund or revocation under Apple’s rules.

2. Platinum membership

Where available, Platinum is an automatically renewing monthly subscription. While active, it includes full-game access, unlimited account invitations, optional contact-sharing features and reconnection with consenting partners.

Contact sharing is never automatic. It requires both players’ separate permission, gameplay eligibility and the required verified Platinum access. A purchase does not provide another person’s consent or authorize optional AI reflections.

For online gameplay beyond the seven-question sample, each player must have verified full-game access through their own Full Game purchase or active Platinum subscription.

When Platinum expires, its membership benefits end. Full-game access also ends unless the player separately owns the one-time Full Game unlock. Losing purchase access does not itself erase saved game progress.

3. Prices and payment

The actual localized price and, for Platinum, the monthly billing period are displayed in the app and Apple’s purchase confirmation before payment is authorized. Prices may vary by country or region.

Payment is charged to the Apple Account used for the purchase upon confirmation. The seven-question gameplay sample is not a free subscription trial. No subscription trial or discount should be assumed unless expressly displayed in Apple’s purchase offer.

4. Automatic renewal and cancellation

Platinum renews automatically each month unless cancelled at least 24 hours before the current subscription period ends. Apple may charge the applicable renewal price within the final 24 hours of that period.

You can manage or cancel the subscription using “Manage or cancel Apple subscriptions” in the app’s Account or Platinum section, or through iPhone Settings → your name → Subscriptions → Cards On The Table.

Cancellation normally stops future renewal and leaves access available until the paid period ends, unless Apple refunds or revokes the purchase. Cancellation does not itself guarantee a refund.

5. Restoring purchases and verification

Use “Restore purchases” in the Full Game or Platinum section to restore eligible purchases using the same Apple Account that originally made them. Restoring an expired subscription does not reactivate it.

Online benefits also require signing into the game account associated with the purchase and successful server-side verification through RevenueCat. Restoring an Apple purchase does not recreate a deleted game account or deleted gameplay data.

Pending, cancelled or unverified purchases do not grant new purchase benefits. If restoration fails, contact cardsonthetabledatinggame@gmail.com.

6. Refunds and consumer rights

For purchases billed by Apple, request a refund at https://reportaproblem.apple.com/ or contact Apple Support. Eligibility and approval are determined under Apple’s applicable policies and consumer law. A refund is not guaranteed, and a refunded or revoked purchase may lose its associated access.

Nothing in these Terms limits any mandatory consumer rights or remedies available under applicable law.

7. Account deletion and subscription billing

Deleting your game account, signing out or uninstalling the app does not cancel an Apple subscription or stop recurring billing. To stop future renewal, cancel the subscription separately through Apple’s subscription settings.

Account deletion does not itself refund a purchase. Apple and RevenueCat may retain purchase-related records as described in the Privacy Policy and their respective policies.

Third-Party Infrastructure and Purchases

The Application utilizes external providers to verify purchase tiers and handle store logic. Below are the privacy and usage links for the systems handling your data:

Internet Connectivity and Billing Responsibility

Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.

If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.

Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

Nothing in these Terms shall limit any rights you have under applicable consumer protection laws that cannot be lawfully excluded.

Limitation of Liability and Third-Party Disclaimers

To the maximum extent permitted by applicable law, the Service Provider provides the Application and its online features on an "As-Is" and "As-Available" basis, without warranties of any kind. Third-Party Infrastructure Disclaimer: The Application relies on external, third-party infrastructure and transaction platforms—specifically Apple Inc. and RevenueCat, Inc.—to handle store logic, secure user data, and verify purchase tiers. The Service Provider does not own, control, or operate these underlying networks. Consequently, the Service Provider explicitly disclaims all liability for financial losses, service interruptions, transaction errors, or data corruption caused directly or indirectly by system outages, server failures, or processing errors within these third-party platforms. Cap on Liability: In no event shall the Service Provider’s total aggregate liability to you for all claims, damages, or causes of action exceed the net amounts received and retained by the Service Provider from your specific purchases within the three (3) months preceding the event giving rise to liability, or fifty dollars ($50.00), whichever is lower. Exclusions: Nothing in these Terms shall limit or exclude the Service Provider's liability for death or personal injury caused by gross negligence, fraud, or any other liability that cannot be lawfully excluded or limited under mandatory consumer protection laws in your jurisdiction.

Application Lifecycle and Legal Terms

Privacy Policy Integration and Entire Agreement

The Application processes personal data in strict accordance with the Cards On The Table Zodiac App Terms Of Use (Terms Of Use Policy).

To review how your profile data, match requests, answers, and choices are collected, stored, and managed, you must read the app-specific policy directly at: cardsonthetabledatinggame.com (Privacy Policy Page).

Governing Law and Dispute Jurisdiction

These Terms and your use of the Application are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles.

If you access the Application as a consumer, this choice of law does not deprive you of the protection afforded to you by mandatory provisions of the applicable consumer protection laws in your local jurisdiction.

You explicitly agree that any operational, transactional, or backend infrastructure processes utilized by the Application (including, but not limited to, store verification, purchase tracking, and cloud data routing handled by third-party providers such as Apple or RevenueCat) are legally deemed to execute and clear outside your local jurisdiction.

To the maximum extent permitted by law, any claim or dispute arising directly out of these backend service links must be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts, and you consent to the personal jurisdiction of those courts. Updates are posted on this page and effective as of 2026-10-12.

Service Availability, Privacy Link, and Governing Law Service Availability vs. Software License Continuity:

The Service Provider reserves the right to modify, update, or discontinue the hosted online features, cloud matchmaking infrastructure, and server-side databases (collectively, "Online Services") at any time. A modification or complete shutdown of the Online Services does not automatically terminate your standard software license to retain, open, or run the local application container on your physical mobile device. In the event that Online Services are discontinued, your underlying software container license (governed primarily by Apple’s Standard EULA) remains intact for local, on-device usage. Privacy Policy Integration: The Application processes personal data in strict accordance with the Cards On The Table Zodiac App Privacy Policy. To review how your profile data, match requests, answers, and choices are collected, stored, and managed, you must read the app-specific policy directly at: ://cardsonthetabledatinggame.com. Generic "Privacy Policy" links located in the website footer or hosting platform layout (such as Flycricket's structural layouts) govern those third-party services only and do not constitute the Service Provider's operational policy. Governing Law and Precise Jurisdiction: These Terms, the software functionality, and all core service relationships are governed strictly by the laws of the Commonwealth of Massachusetts, United States (the location of the Service Provider's establishment), without regard to its conflict of laws principles. Any legal action or dispute arising out of or relating to these Terms, the Application, or its third-party backend links (including RevenueCat data processing) must be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts, except where mandatory local consumer protection regulations in your country of residence unconditionally dictate otherwise.

Use code with caution.
